概要

不動産の権利関係を記録する公的な帳簿です。日本では法務局が不動産登記簿を管理しており、土地や建物の所有権、権利関係、法的制約などを記録しています。

The real estate registry is a public record that documents the legal rights related to real estate. In Japan, the Legal Affairs Bureau manages the real estate registry, recording ownership, rights, and legal restrictions concerning land and buildings.

登記簿の構成

不動産登記簿は、一般的に以下の3つの部分に分かれています。

表題部

これは不動産の基本的な情報を記載しており、土地の場合は地番、地目、面積などが含まれます。建物の場合は家屋番号、種類、構造、床面積などが記録されています。

This section contains basic information about the real estate. For land, it includes plot number, land type, and area. For buildings, it records house number, type, structure, and floor area.

権利部甲区

不動産の所有権に関する情報を記録しており、所有者の名前や所有権の変動などが記載されています。また、所有権の移転時にはその日付や原因も記録されています。

This section contains information about ownership, including the owner's name and changes in ownership. It also notes the date and cause of ownership transfer.

権利部乙区

所有権以外の権利に関する情報が記録されています。たとえば、抵当権、地上権、地役権、賃借権などが含まれます。

This section records rights other than ownership, such as mortgages, land leases, easements, and rental rights.

登記簿の役割

不動産登記簿は、以下のような役割を持っています。

権利の公示

不動産の権利関係を公的に明確化することで、第三者との取引における安心感を提供します。

権利の保全

登記簿に記録された権利は法的に保護され、トラブルが発生した場合に証拠として利用できます。

登記簿の閲覧と取得

不動産登記簿は、法務局で閲覧したり、登記簿謄本（登記簿のコピー）を取得したりすることで確認できます。オンラインでの取得も可能で、登記情報提供サービスを利用することで、自宅からでも登記簿謄本を取得することができます。

You can view the real estate registry or obtain a copy (a certified copy of the registry) at the Legal Affairs Bureau. It's also possible to obtain it online through the Registration Information Provision Service, allowing you to access it from home.

注意点

不動産登記簿は公的な記録ですが、完全な正確性を保証するものではありません。

時折、古い情報や誤記などが含まれる可能性があります。そのため、不動産取引や法的手続きの際には、登記簿の情報を確認し、必要に応じて専門家に相談することが重要です。

Although the real estate registry is a public record, it doesn't guarantee absolute accuracy. Sometimes, it may contain outdated information or errors. Thus, when engaging in real estate transactions or legal procedures, it's essential to verify the information in the registry and consult a specialist, such as a judicial scrivener, if needed.
